Terms of Use

General: By using ConnectTheArts.com, the user agrees to accept and abide by the Terms of Use and Privacy Policy posted on the CTA website (the “Website”). CTA reserves the right to change the Website services, Terms of Use, and/or Privacy Policy at any time. CTA will post notifications of changes in the Terms of Use in the Terms section and changes in the Privacy Policy in the Privacy section of the Website.

Availability of Products and Services: Soulwork Source, Inc., operating as Connect the Arts (“CTA”) may make changes to the services, and other information shown on this Website at any time and may discontinue the operation, maintenance, or provision of this Website at any time without liability to you or any third party. Not all of the services described on this Website may be available in all geographic areas, and the services may vary from area to area and are subject to change without notice. The services described on this Website will be offered only in jurisdictions where it is lawful to do so. CTA reserves the right to revoke, deny, or limit website access and services to anyone at any time without explanation or prior notice; failure of CTA to take action immediately does not mean that CTA is relinquishing any rights with respect to taking action in the future.

Other Agreements: Some of the products and services described on or accessible through this Website may be subject to separate terms and conditions, in addition to the terms of this Agreement. In the event of a conflict, such separate terms and conditions will govern and control with respect to the corresponding product or service. Nothing in this Agreement is intended to affect or amend any agreement(s) or contract(s) between you and CTA with regard to the sale of any particular product or provision of any particular service. Our relationship with you with regard to any such particular product or service shall be governed by the written terms of the agreement or contract contemplating that product or service, including all purchase order terms and conditions. If you link to or access a separate website or online service maintained by CTA or any of its subsidiaries, you should review any terms of use applicable to that website or online service, which will govern your access to and use of any such website or online service.

Links to Third-Party Websites: This Website may contain links to websites that are maintained and controlled by third parties and not by CTA. The third-parties maintaining and operating such websites are solely responsible for their websites’ content. We disclaim all liability for any information, materials, products, or services available on or offered through such third-party websites. We provide links to third-party websites solely as a convenience to you, but we do not endorse or sponsor any third-party or their products or services. Availability of a link to a third-party website from this Website does not create an affiliation or partnership between CTA and any third-party. You should also be aware that third-parties have different terms and conditions and privacy policies governing use of their websites and may treat your personal information differently than CTA does. We remind you to always use good judgment and discretion whenever browsing the Internet, especially when making purchases, obtaining information, or transmitting information.

Privacy: Please review CTA’s Privacy Policy that describes the types of information we gather when you visit and use the Website. Please contact us immediately if you have any concerns about the security of your personal information or feel you have been the victim of fraud or identity theft involving any information you may have shared with us. CTA’s Privacy Policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that CTA can use such data in accordance with our Privacy Policy.

Unauthorized Use: CTA’s primary goal is to facilitate and promote the arts and artists, and all user activities and content posted by users must be consistent with this goal. You agree not to use the Website for any illegal purpose, including, without limitation, transmitting any information that is unlawful, libelous, harassing, abusive, threatening, obscene, hate speech, illegal, invasive of another’s privacy, or includes another person’s or organization’s identification information or sensitive financial information without permission, that promotes violence or self-harm, or that violates the rights of others. You also agree not to collect CTA users’ content or information using automated means without permission, to conduct unlawful, multilevel marketing such as pyramid schemes, to upload viruses or other malicious code, to attempt to obtain login information and other nonpublic user data belonging to another CTA user, to use the Website in a way that is unlawful, misleading, malicious, harmful, or discriminatory, or to do anything that could disable or impair the proper working of the Website. You also agree only to use this Website for your own personal and internal business purposes and not to make any unauthorized commercial use of this Website or any information contained therein. CTA will be the sole judge of whether user content and/or activity is consistent with CTA standards. CTA may remove content that it considers objectionable, and, in cases of suspected illegal activities, CTA may notify law enforcement agents as appropriate.

Our Intellectual Property: You acknowledge and agree that CTA, our licensors, and/or our service providers own and retain all rights to this Website and its content, including without limitation, all images, text, software, photos, sound recordings, graphics, and videos. You may access and use the foregoing only for your own internal, informational, noncommercial purposes as expressly permitted under this Agreement. You may not copy any of the material on this Website, upload, post, publish, transmit, or distribute it in any way, or create other works based on it, without CTA’s prior written consent. You may, however, make copies incidental to, and in the ordinary course of, your personal or internal business use of this Website, provided you do not remove or alter any copyright, trademark, or other notices or disclaimers.

Copyright Protection: We respond to notices of alleged copyright infringement and terminate accounts and postings of infringers (and repeat infringers) according to the process set out in the U.S. Digital Millennium Copyright Act. If you think someone is violating your copyrights and want to notify us, please contact us at dmca-notice@connectthearts.com.

If you are a website that links to ours and you object to our website embedding or linking to your media on our website, please let us know and we will work with you to address the situation promptly, including removal of such links or embedded material if necessary.

Your Content in Our Services: Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. When you upload, submit, store, send, or receive content to or through CTA’s Services, you provide CTA (and our licensors and/or our service providers) with a worldwide, royalty-free license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations, or other changes we make so that your content functions in a preferred fashion in accordance with our Services), communicate, publish, publicly perform, publicly display, and distribute such content. The rights you grant to CTA and our licensors and/or our service providers as part of this license are for the limited purpose of operating, promoting, and improving CTA’s Services, and to develop new services for customers like you. This license will continue even if you stop using our Services. For example, if the user is a photographer and uploads his/her photographs to the Website, CTA recognizes that the user is still the owner of the photographs. At the same time, CTA also recognizes (and the user, by using the Website, agrees) that CTA has the right to use such photographs in promotion of the Website, for example in marketing materials, without payment to the user.

The user also allows everyone, including all other CTA users and people unconnected to CTA, to access and use that Website posted information and to associate it with the user (i.e., the user’s name and profile picture). When a user modifies or deletes data from the CTA website, the original data may still be present in backup copies for a reasonable period of time and potentially could be restored to the Website if the backup copy is reinstalled because of a system failure. When a user terminates a CTA account, the data may still be present in back-up copies, but will no longer be available to others. Additionally, when a user modifies or deletes data from the CTA website or terminates a CTA account, CTA reserves the right to hide such data from public view but to retain administrator access and privileges to such data for as long as CTA deems necessary and reasonable. If a user desires to delete data permanently from the CTA website, the user may make such a request to CTA in writing, which request CTA will reasonably consider but reserve the right to retain backup copies in any event. When a user submits feedback and suggestions regarding the Website, the user gives CTA the right to use the submitted information as CTA sees fit without compensation or any other obligations.

Some of our Services may offer you ways to access and remove content that has been provided to us and on the website. Also, in some of CTA’s Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services, enabling you to control to some extent how the content can be used. Notably, our systems may analyze your content (including postings) to provide you personally relevant features, customized search results, tailored advertising, and spam and malware detection. This analysis occurs when the content is sent and received, and later stored. You can modify or delete posted content, you can terminate your CTA account, and you can report to CTA any perceived inappropriate site content or activities by other site users. CTA may consider and take actions based on these reports, but assumes no responsibility to do so.

Use of the Website: By using the Website, you agree:

  1. To use only the user’s (or user’s business’) real name (or legitimate stage name) when creating a profile page or other site content;

  2. To post only content that is genuinely associated with the user (or user’s business);

  3. To post only content that is either owned by the user (or user’s business) or for which the user (or user’s business) has obtained permission for use on CTA;

  4. Not to post intellectual property, copyrighted content, trademarks, or any other legally protected content not owned by the user (or the business the user is representing on CTA) without permission;

  5. Not to use content owned by CTA or other users (including branding and logos) without permission;

  6. Not to claim to be another person, falsely claim to represent an organization, create a false identity or organization on CTA, or engage in any form of fraud or deception;

  7. To accept full and exclusive responsibility for all aspects of the user’s activities and content on the CTA website; CTA may remove, edit, or refuse to display content that is illegal or that is judged to violate CTA standards or Terms of Use; however, CTA does not guarantee that all or any user content will be reviewed and assumes no responsibility to perform such reviews;

  8. Not to copy, modify, distribute, sell, or lease any part of CTA website content or services (including other users’ content and services) without written permission;

  9. Not to compromise the privacy or security of other CTA users;

  10. Not to interfere with the CTA website or services or to access the CTA website by any method other than the interface provided by CTA;

  11. To update the appropriate CTA account information within 48 hours in the event of changes in email address or mobile phone number to ensure that CTA related information is not sent to the wrong person;

  12. To check the Terms of Use and Privacy Policy periodically and terminate the user’s CTA account and stop using CTA if the user (or business for which the user is acting) does not agree to abide by the current Terms of Use or Privacy Policy

If a user is using CTA on behalf of a business, that business accepts the CTA Terms of Use and Privacy Policy.

CTA reserves the right to delete or modify all user data.
